This website is operated by Get Dress'd. Throughout the site, the terms “we”, “us” and “our” refers to Get Dress'd. Get Dress'd offers this website, including all information, tools and services available from this site to you, the user, conditional upon your acceptance of all terms, conditions, policies and notices stated herein.

By visiting our site and/or renting something from us, you engage in our “Service” and therefore agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referred to herein and/or are available by hyperlink. These Terms of Service apply to all users of the site, including but not limited to those who browse, vendors, customers, merchants, and / or contributors of content.If you do not agree to all the terms and conditions of this agreement, then you are required to exit from this website immediately. 

Any new features or tools that are added to the current store shall also be subject to these Terms of Service. We reserve the right to update, change or replace any part of these Terms of Service and will do so by posting updates and/or changes to our website. Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

 

LEGALLY BINDING CONTRACT

These Terms & Conditions constitute a binding legal contract between you and Get Dress'd. When visiting our Website and/or renting something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms” AND “The Rental Agreement”), including those additional terms and conditions and policies referenced herein. These Terms & Conditions apply to all users of the Website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. When using the Website you will be taken to have accepted all of the Terms & Conditions.

IMPORTANT

You agree that you are renting products and ownership of the product remains with Get Dress'd at all times. Our products may be rented for customers who are under the age of 18 however we only rent directly to adults who may rent the products on behalf of a minor. By clicking “I accept” Terms & Conditions/Rental Agreement button you represent that you are over 18 years and are authorized to use the chosen method of payment with the purpose of renting the products on the order.

CHANGES TO SERVICES OFFERED AND PRICES

Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

PRODUCTS AND SERVICES 

Our company strives to provide accurate descriptions of our products, including photographs and details about sizes and colors. We encourage customers to carefully choose their garments as we do not offer refunds or store credits for reasons such as changing your mind, the garment not fitting, not suiting you, or not liking the color. For more information on our refund policy, please refer to the Refund Policy section on our website.

Please note that descriptions of products and pricing are subject to change without notice at our discretion. We also reserve the right to discontinue any product at any time. Any offers for products or services on our site are void where prohibited.

We cannot guarantee that the quality of our products, services, information, or other materials will meet your expectations. Additionally, we do not guarantee that any errors in our service will be corrected.

GARMENT CARE 

While our garments are in your care, do not  wash, dry clean, alter or remove/attempt to remove any stains from them in any way. We take care of all cleaning with our preferred methods. If there are any marks/stains and further dry cleaning is required, you will be liable for this cost - around $29+. you will be contacted about the stain and advised about the next steps for completing this issue.

We want you to enjoy the garment but we also want the next customer to enjoy it as well so we therefore would hope you treat the garment with the utmost care.

Although you may not be the first to wear the garment we do everything we can to keep it in the most pristine condition. Please be mindful of embellished clutches or jewellery that may snag the material, and avoid spray perfumes or beauty sprays directly onto the material. Please do not attempt to fit into a dress that is not the right size for you and force zippers etc. We will always endeavour to mention dresses that are an ‘in between size’ or a smaller fit than what their label suggests.  

If a garment comes back extra dirty but does not require professional cleaning a cleaning fee of $20 will be charged for time, usage of cleaning supplies and inconvenience. 

 

CANCELLATION / REFUND POLICY

Rental fees are non-refundable.

If you need to cancel your rental and you give us one week or more notice from your booking date, then we can happily issue you full store credit to be used within 6 months from date of cancellation. 

If you need to cancel your rental and you give us 2-6 days notice from your booking date, then we can happily issue you 50% store credit to be used within 6 months from date of cancellation.

If you need to cancel your rental and you inform us the day before or on your booking date, then we cannot offer any store credit. 

Credit cannot be used towards any buy now products, ex rentals, try on fees, damage fees or late fees.

 

COOPERATION 

In the event of refused cooperation with Get Dress'd, including the likes of ignoring communication, false statements, payments, names and addresses, Get Dress'd reserves the right to refer the matter to Bay Corp Limited Debt Collection agency. as a result this will affect your credit rating score for the next 5 years. this limits your ability to be able to apply for any bank loans, credits cards, home loans, and other financial support methods.

FEES

As stated in the rental return information, you are required to return your rental the next working day after your event. If you do not return your rental within the specified timeframe, you will be charged a fee of $20 for every day it is late. This will be charged via the payment source you provided us at checkout.

If a rental is not returned at all, and you fail to contact us about it ASAP; or the garment is damaged to the point where it is unusable, you authorise Get Dress'd to charge back to the account that you used to pay us, the full Recommended Retail Price (RRP) of the garment.  The RRP is listed against each item on our site. 

TRY-ONS – In store only!

Our in store try ons are by appointment only, we do not accept walk-ins. Try ons are based at my home in Napier and the address will be provided once the booking has been confirmed. These can be booked through Instagram message to our page @getdressd_

Try ons must be booked at least a few days in advance. Bookings are a duration of 30 mins and require a $10 non refundable booking fee. This fee is to prevent no shows, late cancellations and to compensate for our time and extra care put into every appointment. 

 By booking a try on you are legally agreeing to our terms and conditions so they still 100% apply if you book/take away a garment from your appointment. 

We understand that at times you may need to bring your child & we totally understand that! we just ask that you ensure children are kept on the large rocking chair provided or on the floor/ in a capsule or pram to keep them safe and to avoid any damage to our garments or fixtures. Any damage done by a child will be charged to ‘you’ as the customer/renter.

 

LATE OR NON-RETURNS

Get Dress'd ensures the arrival of all rental garments to the customer, and this relies heavily on timely returns. Garments can be consistently booked out and by delaying the return of a garment it can potentially inconvenience the following rental customer.  No-one wants to be left without a gorgeous outfit for their event. If garments are not returned the following business day to their booking date, late fees will be charged at $20 a day for every day it is late, per garment  + the cost of any subsequent rentals that had to be canceled due to the late return.

In the case that a garment is not returned at all, due to it being stolen, lost or kept by the renter, the full Original Retail Value will be charged on top of the rental price that was paid and the total late fees. We will take strong legal action against you if this occurs. 

When you hire from Get Dress'd, you are purchasing the right to wear one of our gorgeous garments during your agreed rental period, stated on your confirmation email and in our system. Only you, the renter, is able to wear the rented item and therefore it is not to be shared around to others while in your possession.

In the event that theft or malicious behaviour occurs and or late fees & damage fees are not paid we will use the services of baycorp, disputes tribunal or small claims court to recover any debts incurred by you the customer/renter. 

Any fees from retrieval services will be charged to you.

 

DAMAGED/SPOILED/REPLACEMENT GARMENT REQUIRED

Our biggest piece of advice, when wearing one of our garments, is to treat it as if it were your own. In the situation, a garment is damaged while in your care, the best thing to do is to not stress and notify us as soon as possible so we can come up with a quick solution. The matter must be messaged through to our instagram oage @getdressd_ as this is our best form of communication. We must be notified the day of or after your event,  not upon the return of the garment. 

If any damage occurs while the garment is in your care (as soon as it has been picked up) even if you directly didn’t cause the damage, or are unsure how the damage occurred, you are still 100% to pay for any costs. It is your responsibility!! 

 The following rules apply to damaged garments

  • If the garment requires excessive cleaning, extra cleaning products, scrubbing, soaking, more than 1 machine wash + extra drying time then an extra fee will be charged accordingly. We base this fee on time and product used. 
  • If the garment needs a minor repair, (e.g. zipper needs fixing, strap replacement or hem taken up as a result of damage), a fee will be charged at cost + 50% to cover my time and costs. 
  • If damage inflected by a renter affects another customer then the renter will be liable to pay any necessary costs to compensate. 
  • If the garment has been damaged to the point where we need to lower the rental price then the renter must pay the difference in price x6 to compensate as well as the repair cost.
  • If the damage to the garment means it cannot be used again for rent, 100% of the “Recommended Retail Price” (RRP) will be charged to you.  Discussions regarding the repayment of the garment can be sorted out in various ways so it is important to email or text to make the appropriate arrangements.  Once the garments RRP is paid for you will have the option to keep it, if the full RRP isn’t paid then you won’t have the option to keep it.  Note the RRP is found in the production description of each garment. You will receive an invoice for the replacement price of the garment or the cost of damages as determined by Get Dress'd. If you, the renter fails to pay these charges you authorise Get Dress'd to seek full compensation for the full RRP of the garment, the cost of any rentals we need to cancel, late fees of $20 per day that the garment is still not returned past its rental period end date. Methods can include but are not limited to debt collection agencies. Renters must themselves cover recoverable collection costs should we need to use debt collection.
  • Get Dress'd also reserves the legal right to take all steps necessary to receive the required compensation or fees required by breaking these terms & conditions. Such as legal action and debt collection.

We will only charge your payment method when you have not upheld your commitment to us as set forth in the Terms & Conditions/Rental Agreement.

 

NATURAL DISASTERS/STATE OF EMERGENCY

In the event of a natural disaster, civil defence emergency or state of emergency all bookings, where possible will be cancelled and credited. However in the event that items have already been posted or picked up, Get Dress’d hereby reserves the right to not offer a refund or credit. 

 

UNLAWFUL ACTIONS

You may not use any of the products for any illegal or unauthorised purpose nor may you , in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms & Conditions will result in an immediate termination of your Services and leave me no choice but to undertake legal action against you.  Any attempt to steal garments will be dealt with by law enforcement.

 

DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Get Dress'd, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

These Terms & Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Zealand.

Postal Rentals – Terms & Conditions

1. Nationwide Overnight Shipping
We offer overnight postal delivery for bookings made by 3PM each Tuesday. Orders are dispatched every Wednesdayusing tracked overnight courier. This schedule ensures your dress arrives by Friday, allowing a one-day buffer in case of any courier delays.

2. Delivery & Tracking
All garments are sent using tracked courier services. While no signature is required, the delivery driver is required to take a photo of where the item is delivered. This provides proof of delivery while allowing the parcel to be left in a safe location if no one is home.

We have chosen not to require signature delivery to avoid situations where the courier attempts delivery while you are out (e.g. during the day on Friday), which could result in the parcel being taken to a depot and not being available in time for your event. It is your responsibility to provide a safe and secure delivery address (e.g. work address, or somewhere someone will be available) to ensure you receive your rental in time.

We are not responsible for parcels lost, stolen, or damaged after confirmed delivery.

3. Return Process
Your rental must be lodged for return on the next business day following your event, using the provided prepaid return bag. The parcel must be handed over the counter at a NZ Post branch or approved agent before that day’s cut-off time of 5PM. Do not use drop-boxes or untracked return options, as these can lead to delays and late fees.

4. Late Returns
A late fee of $25 per day applies for each day the item is not returned on time. If the garment is not returned within 5 days, it will be considered a non-return, and you will be charged the full replacement value of the item. Legal action may be taken to recover losses.

5. Damage, Loss or Theft
If the garment is lost, stolen, or damaged beyond repair while in your care, you will be charged the full RRP (recommended retail price). Minor damage or excessive cleaning may incur additional charges. Do not attempt to clean the garment yourself.

6. Cancellations
Postal bookings cancelled before 3PM on Tuesday are eligible for store credit only. Once the garment has been packaged for dispatch, no cancellations, refunds, or credits will be issued.

7. Failed or Missed Deliveries
If the courier is unable to deliver your parcel due to incorrect address details or unsafe delivery locations, Get Dress’d is not responsible. No refunds or credits will be issued in these situations.

8. Fit & Style Issues
Refunds or credits will not be given if the garment does not fit or suit you. Please check the size guide and contact us in advance for help choosing the right style or fit.
